Terms of Use

These Terms of Use ("Terms") govern your access to and use of TaskPole (the "Service"), operated by NERD LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2. Acceptable use

You agree not to use the Service for any unlawful purpose, to harass others, to upload infringing or harmful content, or to disrupt the Service. We may suspend or terminate accounts that violate these Terms.

3. User content

You retain ownership of tasks, messages, images, documents, reviews, and other content you submit ("User Content"). You are solely responsible for your User Content and represent that you have the rights to submit it. We do not endorse and are not responsible for any User Content.

4. Rewards

Rewards are arrangements between users. TaskPole and NERD LLC are not a party to, and bear no responsibility for, the fulfilment, value, taxation, or legality of any reward. We provide tracking tools only.

5. Subscriptions & payments

Paid memberships are billed in advance on a recurring basis through our payment processor. You may cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by law.

If a payment fails we will notify you, and the membership continues while your card issuer is retried. If the retries do not succeed the membership ends and the account returns to the Free tier. Ending a membership never deletes anything — your tasks, groups, rewards and history remain and remain readable; only the limits that apply to creating new items and to notification delivery change back.

6. SMS reminders & opt-in

A phone number is optional. Every feature of the Service works without one, and reminders are available by email regardless. We will never send you a text message unless you have both saved a phone number on your profile and ticked the SMS opt-in box shown beside it. Saving a number without accepting that notice is refused.

By accepting the SMS opt-in you agree to receive automated text message reminders from TaskPole at the number on your profile, about tasks you create or are assigned to. These are transactional reminders only — we do not send marketing messages by SMS. How often you hear from us depends entirely on the reminders set on your tasks; there is no fixed schedule. Completing a task stops its reminders.

Message and data rates may apply, according to your mobile plan. We do not charge for SMS reminders, and we are not responsible for charges your carrier applies. Delivery depends on your carrier and network and cannot be guaranteed.

How to withdraw your consent. Go to My Profile and either untick the SMS opt-in box or clear your phone number, then save. Either takes effect immediately and stops all SMS reminders; clearing your number also withdraws the opt-in. Your email reminders are unaffected, so a reminder set to "Both" continues to arrive by email. The same page is where you change the number itself — a new number is texted only after you save it with the opt-in still accepted.

We record the date and time you accepted the opt-in as evidence of your consent, and we treat your phone number as private: it is never shown to other users. When someone sets an SMS reminder on a task, we tell them only whether each assignee can currently receive one — never the number itself.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of liability & indemnification

To the maximum extent permitted by law, TaskPole and NERD LLC, and their officers, employees, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of the Service, your User Content, reviews, images, or documents, or any interactions between users.

You agree to indemnify, defend, and hold harmless TaskPole and NERD LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, your User Content, your conduct, your rewards, or your violation of these Terms or any law or the rights of any third party — including any legal, social, or moral consequences of content you create, post, or share.

9. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
